Terms of Service

These Terms of Service ("Terms") govern your use of the AI-powered, prompt-based token-creation service on the Solana blockchain ("Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. Definitions

• Service: The AI system and accompanying interface that allow Users to submit text prompts to generate new tokens on the Solana blockchain.
• Provider: The operator of the Service.
• User (or "you"): Any individual or entity that registers for or uses the Service.
• Token: A digital asset created on Solana as a result of a User's prompt.

2. Acceptance of Terms

By registering for or using the Service, you acknowledge that you have read, understood and agree to be bound by these Terms. The Provider reserves the right to modify these Terms at any time; continued use of the Service after such changes constitutes acceptance of the new Terms.

3. Service Description

The Service enables Users to submit text prompts. In response, an AI engine generates and deploys a corresponding Token on the Solana network. All Token deployments are recorded immutably on the blockchain.

4. Account Registration and Authentication

• You must register with a valid email address and password to use the Service.
• You agree to provide accurate, current and complete information during registration and to keep it updated.
• You are responsible for safeguarding your account credentials and for any activity under your account.

5. Prompt Content

• You warrant that any prompt you submit does not infringe third-party rights (including intellectual property or privacy rights), and does not contain illegal, harmful, hateful, violent or otherwise objectionable material.
• You retain ownership of your prompts, but grant the Provider a non-exclusive, worldwide, royalty-free license to use, reproduce and display them for the purpose of operating and improving the Service.

6. Pricing and Payment

• Use of the Service may incur fees, which will be published and updated on the Service's website.
• Payments must be made via supported cryptocurrency wallets or credit/debit cards, as specified at the time of payment.
• All fees are non-refundable except as required by applicable law.

7. Intellectual Property

• The Service's software, AI models and documentation are owned by the Provider or its licensors and are protected by copyright, trademark and other laws.
• You own any Tokens you create, subject to the rules and mechanics of the Solana blockchain, but no rights to the underlying Service code or AI models are transferred.

8. Disclaimers; Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND.
PROVIDER DOES NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION, NOR RESULTS OF TOKEN DEPLOYMENT (INCLUDING MARKET VALUE OR TRANSACTION FEES).
IN NO EVENT WILL PROVIDER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

9. User Responsibilities and Indemnification

• You are solely responsible for all prompts and Tokens you create and for compliance with all applicable laws.
• You agree to indemnify and hold harmless the Provider, its affiliates and their officers, directors and employees from any claim or demand arising out of your breach of these Terms or your violation of any rights of a third party.

10. Termination

• You may terminate your account at any time by discontinuing use of the Service.
• The Provider may suspend or terminate your access immediately, without notice, for any violation of these Terms or for any other reason.

11. Changes to Terms

The Provider may revise these Terms at any time by posting updated Terms on the Service's website. Unless otherwise noted, changes take effect upon posting. Continued use after changes constitutes acceptance.
